Sanford Rubenstein sues his rape accuser

Cop-bashing lawyer Sanford Rubenstein filed a defamation lawsuit Monday against the Al Sharpton crony who accused him of raping her after the race-baiting Revs celebrity-studded birthday bash on Oct. 1 at the Four Seasons Hotel.

The suit, filed in Brooklyn Supreme Court, repeats the noted civil rights lawyers claim that he and Iasha Rivers had a night of hot sex that was completely consensual after whooping it up at the party.

Rape charges were dropped Jan. 5 against Rubenstein for lack of evidence.

But the lawyer was then slapped with a lawsuit by the alleged victim, repeating the allegations she made to cops a move that infuriated Rubenstein and his lawyers.

You cannot continue to defame a person, in the hope of securing a cash settlement for a claim that has already been proven false. For Sandy, this legal fight is now not about money, but a matter of principle, said Ben Brafman, Rubensteins lawyer.

Rivers alleged in her suit that Rubenstein attacked her while she was out cold at his Upper East Side penthouse.

But in the court papers, he insists they had consensual sex twice and that Rivers was a more-than-willing participant.

During and throughout two sexual episodes between plaintiff and Mr. Rubenstein, which were several hours apart from one another, plaintiff was obviously sexually aroused and wholeheartedly initiated various sexual acts, the papers state.

The legal papers also want the court to compel Rivers to answer numerous questions about the encounter, including on any intoxicating beverages or medications she ingested at Sharptons party.

Rubensteins lawyers also want her to describe the alleged sexual assault in complete chronological detail, stating everything that you did and everything that you claim happened to you, the papers state.
