Washington (CNN) -- The New York officer involved in the death of Eric Garner should no longer be on the police force, Sen. Rand Paul argued Monday.
The Kentucky Republican said Daniel Pantaleo lacked "discretion" when he placed Garner in a chokehold for allegedly selling untaxed cigarettes.
"You probably shouldn't have the power to be a policeman anymore, at the very least," Paul said at a Mississippi Republican fundraiser, adding that the employment standard for police is "much higher," according to video by the Clarion-Ledger newspaper.
Who is Officer Daniel Pantaleo?
His comments come as Paul aggressively works to expand his appeal among nontraditional GOP voters ahead of his expected presidential campaign.
After the July 17 chokehold incident, Pantaleo was put on modified assignment and stripped of his badge and gun while an investigation into Garner's death was under way.
A grand jury decided last week not to charge Pantaleo, a decision that resulted in racially charged protests across the country.

Dr. Rand Paul is the junior United States Senator for Kentucky. Elected in 2010, he has proven to be an outspoken champion for constitutional liberties and fiscal responsibility, and a warrior against government overreach. Rand has been married for 23 years to Kelley Ashby of Russellville, Ky., and they have three sons.

(CNN) -- Anthony Weiner thinks Rand Paul is playing it smart.
The former Democratic congressman from New York, who resigned in 2011 amid a sexting scandal, offered up some 2016 insight Friday, saying the Kentucky Republican senator is wise to make privacy concerns a big part of his potential presidential platform.
"Paul's strategy could put him in a great place in a Republican primary," Weiner wrote in a column for Business Insider.
Paul has been the most vocal opponent in Congress against the National Security Agency's domestic surveillance programs involving phone metadata collection.
He filed a now-stalled lawsuit against the Obama administration earlier this year, and he voted against an NSA reform package last month because he felt it didn't go far enough in tweaking the agency.
(He took some heat, however, from some in the anti-NSA community for his vote because the measure ultimately failed to advance.)
Privacy issues have become a staple in Paul's stump speeches on the 2014 campaign trail, where he was known to hold up his cell phone in the air and declare that what Americans do on their phones is "none of the government's damn business."
