Neil Gorsuch, Guns & the Second Amendment: 5 Fast Facts You Need to Know – Heavy.com

Donald Trumps nominee to the U.S. Supreme Court is generally regarded as a supporter of the Second Amendment and gun rights.

Vigorously praised by the National Rifle Association, Neil Gorsuch has endorsed Second Amendment rights, says FiveThirtyEight. However, there is one ruling that gives some conservatives concern, relating to when police can disarm those carrying firearms.

Although Gorsuchs positions on some hot button issues like abortion are less clear, his stances on the Second Amendment and guns are clearer.

Trump chose Gorsuch, 49 a Denver appellate judge who is known as an originalist to replace the late conservative justice Antonin Scalia.

Heres what you need to know:

In a statement, the National Rifle Association made it clear the group is thrilled with Trumps choice of Gorsuch for the court.

President Trump has made an outstanding choice in nominating Judge Gorsuch for the U.S. Supreme Court. He has an impressive record that demonstrates his support for the Second Amendment, said Chris W. Cox, Executive Director, NRA-Institute for Legislative Action, in a statement.

We urge the Senate to swiftly confirm Judge Gorsuch to the Supreme Court, just as it did in confirming him to the U.S. Court of Appeals for the Tenth Circuit by a unanimous voice vote.

One reason the NRA likes Gorsuch is because he once wrote in a legal opinion: The Second Amendment protects an individuals right to own firearms and may not be infringed lightly.

That comment case in United States v. Games-Perez. He also wrote: There is a long tradition of widespread gun ownership by private individuals in this country.

The case involved a man who claimed he didnt know he was a felon in an illegal gun possession case.

According to the Charlotte Observer, Gorsuch has supported the Second Amendment in his case readings, although some of the cases only tangentially involve gun rights.

For example, in the 2012 case, United States v. Games-Perez, Gorsuch also argued that a felon needed to know not only that he possessed the gun but also that he was a felon for the criminal law to apply, according to the newspaper.

More critically for those trying to assess where Gorsuch stands on gun rights issues, his dissent included a defense of the Second Amendment, in which he wrote, gun possession is often lawful and sometimes even protected as a matter of constitutional right. But he did question whether a felon could be wrongfully imprisoned for possessing a gun, according to the decision.

The American Thinker noted that Gorsuch had joined in the majority in a case called United States v. Rodriguez. The case in New Mexico involved a police officer disarming a man who was carrying a concealed handgun. The officer disarmed Rodriguez before determining he was a convicted felon who didnt have a right to carry, wrote the American Thinker.

The magazine expressed concern that the officers actions would have been upheld even if Rodriguez had been lawfully carrying. According to the 10th Circuits opinion, the police are justified in forcibly disarming every armed citizen based on nothing more than the presence of a concealed firearm. This allows the police to treat every law-abiding gun owner like a criminal, the site reported.

When describing the type of justice he wanted, Trump had said he wanted someone in Scalias mold who will respect the constitution of the United States. And I think that this is so importantalso, the Second Amendment which is totally under siege by people like Hillary Clinton.

Gorsuch is widely described to be similar to Scalia in intellectualism and philosophy. Scalia was a lynchpin on gun issues. According to Newsweek, in 2008s Heller 5-4 decision, Scalia wrote a landmark opinion for the majority of the court that upheld an individuals right to bear arms. His ruling infuriated liberals and settled the questions, at least for now, about whether the phrase well regulated militia in the Second Amendment means people have an individual right to bear arms. Scalia found that they do.

During his nomination press conference, Gorsuch spoke fondly and emotionally about the late justice, calling him a lion of the law.

Gorsuch is described as both an originalist and textualist. As The Washington Post explains them, Like Scalia, Gorsuch is a proponent of originalism meaning that judges should attempt to interpret the words of the Constitution as they were understood at the time they were written and a textualist who considers only the words of the law being reviewed, not legislators intent or the consequences of the decision.

Suit shows ignorance of Second Amendment – Cape Cod Times (subscription)

I write in strong support of Attorney General Maura Healeys vigorous defense of our state law banning assault weapons.

As a Vietnam veteran, I carried an M16 assault weapon in country for 360 days. The members of the Gun Owners Action League who filed suit against the state Jan. 23 totally misinterpret the intent of the Second Amendment. Supreme Court Justice Ruth Bader Ginsburg presents a strong logical statement defining the Second Amendment in the 21st century:

When we no longer need people to keep muskets in their home, then the Second Amendment has no function. Its function is to enable the young nation to have people who will fight for it to have weapons that those soldiers will own. So I view the Second Amendment as rooted in the time totally allied to the need to support a militia. So ... the Second Amendment is outdated in the sense that its function has become obsolete.

Democrats Continue Losing Ways In Battle Against Second Amendment – America’s 1st Freedom (press release) (blog)

Attendees at the Myrtle Beach Gun Show this past weekend may have seen a sad sight as they walked inside the South Carolina citys convention centermembers of a major political party protesting the exercise of a constitutional right. A few members of the Horry County Democrat Partys Gun Sense Committee, numbering less than a dozen (including some kids the protestors dragged along) held signs calling for more gun control laws in South Carolina and used a compliant local media to attack gun shows and those who attend them.Rather than going over and having a conversation with gun owners, these party activists were more interested in condemning them instead.

According to WBTW-TV in Myrtle Beach, Rosemary Wolfe, with the Democrat Partys Gunsense Committee, believes that gun shows are an example of how accessible firearms are, telling the station that while she and fellow activists were stumping for more gun laws, inside the show, You can get a discount on assault rifles. Based on the paltry number of protestors, it looks like there are many more South Carolinians interested in a good deal on a gun than there are interested in trying to shame people for exercising their constitutional rights. Many Democrats, though, just dont seem to care about that. Rather than going over and having a conversation with gun owners, these party activists were more interested in condemning them instead.

So, where has this gotten Democrats in South Carolina? In the 2016 elections, Donald Trump won almost 55 percent of the presidential vote to Hillary Clintons 41 percent, improving on Mitt Romneys 11-point election victory in the state in 2012. Republican Sen. Tim Scott won a full term in the U.S. Senate by running up more than 60 percent of the statewide vote. The Democrat candidate, Thomas Dixon, could only get the support of 37 percent of the states voters. Six Republican candidates won election or re-election to the U.S. House of Representatives, while only one Democrat, James Clyburn (in office since 1993) won a House race. In the state legislature, Democrats hold just 18 of the 46 seats in the state Senate, and only 44 seats in the state House, compared to 80 for Republicans.

Not only is gun control not the way to reduce violent crime, its not going to win you many elections throughout the country. Sure, there will always be places where voters dont see why anybody needs a gun, and will vote for the anti-gun candidate in every election. But there are many more legislative districts at both the state and federal level where the majority of voters actually do care about protecting and exercising their Second Amendment rights. The party that demands its candidates follow the lead of Barack Obama, Hillary Clinton, Nancy Pelosi and Chuck Schumer isnt going to play well with the men and women who liveand votein these districts.

This is one reason why Michael Bloomberg can outspend gun owners in Maine by a more than 6-to-1 margin and still get defeated in his push for a universal background check referendum. Its one of the reasons why so many counties that voted for Barack Obama in 2008 and 2012 went for Donald Trump this year. Its one of the reasons why Republicans control 68 percent of state legislative chambers around the country, and one of the reasons why Democrats have lost more than 1,000 state legislative seats across the United States since 2008. There are tens of millions of American gun owners, and millions of us vote freedom first each and every election. Democrat leaders in D.C. still think they can turn millions of Bloomberg bucks into reliable anti-gun voters, but their efforts actually have cost them seats and made their party brand toxic among many gun-owning voters.It would be nice if both major political parties in the United States supported all our constitutional rights.

Our rights exist for all of us, regardless of political party or ideology. Its not just the right of the political right to keep and bear arms, its the right of the people. It would be nice if both major political parties in the United States supported all of our constitutional rights. Hopefully well get to that point one day. But with members of the Democrat Partys Gun Sense Committee protesting gun shows, were certainly not there yet.
