Cantor Fitzgerald Settles Suit

Financial firm announces $135M Sept. 11 settlement Associated Press (Published: 17-Dec 2013 12:47 PM, Received: 12:47:42 PM) Word Count: 514 NEW YORK (AP) Financial services firm Cantor Fitzgerald, which lost nearly two-thirds of its employees in the Sept. 11, 2001 attacks against the U.S., revealed a $135 million settlement with American Airlines and insurance carriers Tuesday to a judge who said the deal will end the final airplane-focused case resulting from claims of wrongful death and personal injuries.

The agreement averts a trial scheduled for next month, which means there will be no airing of such questions as how terrorists got through security, the best way to stop terrorists, whether there was really wrongdoing and negligence and how best to preserve liberties amid such threats, U.S. District Judge Alvin K. Hellerstein said.

"All this will remain a mystery," he said.

Calling the settlement a significant conclusion after 12 years of litigation that resulted in scores of settlements and not a single trial involving airlines, the judge said, "Hopefully what was achieved was a measure of justice, a measure of reparation and closure."

He added, "But the lives that were lost were irreparable and being irreparable, there now are no words to describe that loss."

The deal was announced by Cantor Fitzgerald attorney John Stoviak, who said money from various insurers is already in escrow and ready to be paid out pending formal approval by the court at or after a Jan. 13 hearing.

Afterward, Cantor Fitzgerald Chairman and Chief Executive Officer Howard W. Lutnick said in a statement that the case for insurance companies "was just another case, just another settlement, but not for us."

Lutnick, whose brother Gary was killed in the attacks, added: "We could never, and will never, consider it ordinary. For us, there is no way to describe this compromise with inapt words like ordinary, fair or reasonable. All we can say is that the legal formality of this matter is over."

Cantor Fitzgerald lost 658 of its 1,000 people in its New York workforce when the 101st through 105th floors of its One World Trade Center headquarters were destroyed when terrorists struck the tower. Howard Lutnick was not in the office.

American Airlines spokesman Sean Collins said in a statement American had "vigorously defended itself in litigation brought against it by property owners and their insurers who allege that American should have done what the government could not do: prevent the terrorist attacks."

Dsseldorf, 16 December 2013 - net mobile AG (ISIN: DE0008137852), Europe's leading provider of mobile value-added services and payment solutions, can be proud of its success in the third quarter of 2013. Revenue increased again slightly by 0.5% compared with the previous quarter, to EUR29,517 thousand. Extraordinary write-downs of EUR1,462 thousand were once again necessary in the third quarter. The company nevertheless achieved positive EBITDA of EUR289 thousand after write-downs. EBITDA after extraordinary write-downs was up EUR2,028 thousand on the previous quarter. EBITDA before write-downs improved by EUR3,468 thousand to EUR1,751 thousand. The consolidated net profit improved by EUR2,245 thousand, it remained negative at -EUR1,970 thousand.

The equity ratio dropped to 16.7% owing to a further increase in total assets, which was largely due to the expansion of business at net-m privatbank, and the losses for the financial year. With total of EUR 46.195 tousand The equitiy remains strong Liabilities to banks have been reduced significantly in the last nine months. This is primarily due to Group financing provided by the NTT DOCOMO Group, which has made as additional credit line of EUR40 million available to net mobile AG. Liabilities to banks have fallen by EUR13,268 thousand as a result.

WordPress is a free and open source blogging tool and a content management system (CMS) based on PHP and MySQL, which runs on a web hosting service.[3] Features include a plug-in architecture and a template system. WordPress is used by more than 18.9% of the top 10 million websites as of August 2013[update].[4] WordPress is the most popular blogging system in use on the Web,[5] at more than 60 million websites.[6]

It was first released on May 27, 2003, by its founders, Matt Mullenweg[1] and Mike Little,[7] as a fork of b2/cafelog. As of 26 November 2013, version 3.7 had been downloaded nearly 10 million times.[8]

WordPress has a web template system using a template processor.

WordPress users may install and switch between themes. Themes allow users to change the look and functionality of a WordPress website or installation without altering the information content or structure of the site. Themes may be installed using the WordPress "Appearance" administration tool or theme folders may be uploaded via http://FTP.[9] The PHP, HTML & CSS code found in themes can be added or edited for providing advanced features. Thousands of WordPress themes exist, some free, and some premium (paid for) templates.

One very popular feature of WordPress is its plugin architecture which allows users and developers to extend its abilities beyond the core installation. WordPress has a database of over 26,000 plugins,[10] each of which offers custom functions and features enabling users to tailor their sites to their specific needs. These customizations range from SEO (Search Engine Optimization) enhancers to content displaying features, such as the addition of widgets and navigation bars.

Prior to WordPress 3.0, WordPress supported one blog per installation, although multiple concurrent copies may be run from different directories if configured to use separate database tables. WordPress Multi-User (WordPress MU, or WPMU) was a fork of WordPress created to allow multiple blogs to exist within one installation but is able to be administered by a centralized maintainer. WordPress MU makes it possible for those with websites to host their own blogging communities, as well as control and moderate all the blogs from a single dashboard. WordPress MU adds eight new data tables for each blog.

As of the release of WordPress 3.0, WordPress MU has merged with WordPress.[11]

Native applications exist for WebOS,[12]Android,[13]iOS (iPhone, iPod Touch, iPad),[14][15]Windows Phone, and BlackBerry.[16] These applications, designed by Automattic allow a limited set of options, which include adding new blog posts and pages, commenting, moderating comments, replying to comments in addition to the ability to view the stats.[14][15]

WordPress also features integrated link management; a search enginefriendly, clean permalink structure; the ability to assign nested, multiple categories to articles; and support for tagging of posts and articles. Automatic filters are also included, providing standardized formatting and styling of text in articles (for example, converting regular quotes to smart quotes). WordPress also supports the Trackback and Pingback standards for displaying links to other sites that have themselves linked to a post or article.

Freiburg, December 13, 2013. S.A.G. Solarstrom AG (German security identification number: 702 100, ISIN: DE0007021008), today filed for insolvency at the District Court of Freiburg i.Br.. Refinancing talks have been held with banks, financial services providers and other creditors as a result of cash inflows that have not been received on time and in view of the operative losses expected since November 29, 2013. In these talks, however, it was not possible to cover at short notice the liquidity shortfalls that have arisen and thus to guarantee payment of liabilities with matching maturity. S.A.G. Solarstrom AG is thus insolvent, although the company is not over-indebted in accounting terms. It is thus also not possible to make the interest payment on the corporate bond (ISIN: DE000A1E84A4, German security identification number: A1E84A), due on December 16, 2013. In the insolvency proceedings, planned under self-administration, the Group will work together with a provisional trustee over the next three months on a restructuring concept in which the creditors are to be closely involved. The goal is a sustainable concept to support the continuation of the Group.

'Within less than four weeks, we were confronted with a situation which was completely unforeseeable for us', says Dr. Karl Kuhlmann, CEO of S.A.G. Solarstrom AG. 'We had firmly scheduled cash inflows from the closing of the sale of German photovoltaic projects, from the closing of an Italian project with 7 photovoltaic systems and from a loan that we had granted to an Italian project company, for November and December. They were delayed for completely different reasons. Altogether, a sum of over EUR20 million is lacking. It has not been possible for us to cover this significant liquidity shortfall, despite all our efforts'.

Insolvencies in the industry delay cash inflows from Germany In the closing of the sale of German projects, S.A.G. Solarstrom AG was already affected by the insolvencies of a module supplier and several service providers during the course of the year. The insolvency of the module supplier led to bank financing for projects being called into question or refused. Alternative insurance solutions accepted by banks were not realizable. With regard to the service providers, alternative solutions also needed to be found and substantial reworking was required. Both delayed the closing of the sale of these systems and thus also the planned cash inflows in the high single-digit million Euro range.

Cash inflow from Italy will now only be received in 2014 During the second half of November, it became apparent that a cash inflow expected in November in the mid-single-digit million Euro range would probably only be received during the course of 2014. This was due to the fact that the sale of an Italian system portfolio could not be closed due to a legal dispute with the network operator. Definitive legal assessments by the external lawyers of the financer in favor of the project company had not called the closing into question.
